Our team use facilitation or mediation to create conversation and restore communication in a relaxed and safe environment, supporting each side to discuss the issues until they agree on a solution. If a lasting and mutual agreement can’t be reached collaboratively, moving to adjudication or arbitration is the next step. That’s where one of our expert team members make an independent decision, creating closure.

An adjudicator is a trained expert who weighs up all the evidence in a dispute and makes a legally binding decision on the matter.
Arbitration
An arbitrator decides on the matter – like a private court
Arbitration is a similar process to adjudication, but more formal. It is often used as a quicker and private alternative to court. The arbitrator’s decision is legally binding.
Our team
Fair Way’s practitioners are fully accredited through the Arbitrators’ and Mediators’ Institute of NZ (AMINZ), the NZ Law Society or the Resolution Institute. Depending on your needs, we can recommend a practitioner with experience in your specialist area.
